This Acceptable Use & Community Policy sets out the standards that apply when using Dapeswe, interacting with others through the platform or publishing content through Dapeswe.
This Policy forms part of the Dapeswe Terms of Use and applies to Customers, Vendors and Advertisers.
- USING DAPESWE RESPONSIBLY
Dapeswe is designed to enable legitimate business activity, transactions, collaboration and interaction between people and businesses.
When using Dapeswe, you must:
- comply with applicable law;
- provide accurate information where accuracy is required;
- respect the rights of other people and businesses;
- use Dapeswe functionality for its intended purpose; and
- comply with the Dapeswe Terms of Use, this Policy and any applicable Additional Terms.
You are responsible for activity carried out through your account and for content you submit or publish through Dapeswe.
- PROHIBITED USE
You must not use Dapeswe to:
- commit, facilitate, promote or encourage unlawful activity;
- commit or attempt fraud, deception or misrepresentation;
- impersonate another person or business or misrepresent your identity, authority or affiliation;
- interfere with the operation, security or integrity of Dapeswe;
- gain or attempt to gain unauthorised access to accounts, systems, data or functionality;
- introduce malware, malicious code or other harmful technology;
- scrape, harvest or systematically extract information from Dapeswe without permission;
- send spam or unsolicited bulk communications;
- manipulate transactions, prices, availability, participation, reviews, ratings or other platform mechanisms;
- create or use accounts to circumvent a restriction, suspension, verification requirement or other Dapeswe measure;
- misuse another person's personal or confidential information; or
- use Dapeswe in a way that creates an unreasonable security, legal or operational risk for Dapeswe or its users.
You must not assist another person in doing something prohibited by this Policy.
- CONTENT AND COMMUNITY STANDARDS
These standards apply to content submitted, uploaded, published or otherwise made available through Dapeswe, including profiles, listings, descriptions, images, events, comments, forum contributions, policies and other user-generated material.
Content must not:
- be unlawful, fraudulent, materially false or misleading;
- be defamatory, threatening or unlawfully harassing;
- promote or encourage violence or unlawful activity;
- contain unlawful discriminatory or hateful content;
- contain obscene or unlawful sexually explicit material;
- exploit, endanger or unlawfully depict children or young people;
- infringe another person's intellectual property, privacy or other rights;
- disclose another person's private or confidential information without appropriate authority;
- contain malware, malicious links or other harmful material; or
- falsely suggest that content, a business, an event or an offer is provided, approved or endorsed by Dapeswe.
Where content states facts about a business, product, service, event or transaction, those statements must not be materially misleading.
Opinions and experiences should be genuinely held.
- MARKETPLACE INTEGRITY
Dapeswe depends on genuine transactions, accurate business information and fair use of its systems.
Customers, Vendors and Advertisers must not manipulate or attempt to manipulate Dapeswe functionality or create a false impression of activity, popularity, availability, reputation or demand.
This includes:
- creating artificial or sham transactions;
- manipulating reviews, ratings or other reputation mechanisms;
- creating multiple accounts to obtain an improper advantage;
- providing false verification or business information;
- misrepresenting prices, availability, products, services or events;
- abusing refunds, chargebacks, promotions, vouchers or Platform Credits;
- interfering with another user's legitimate activity; or
- coordinating with others to circumvent Dapeswe rules or technical controls.
Reviews, ratings and other feedback, where available, must reflect genuine experiences and must not be bought, sold or exchanged for improper incentives.
Off-Platform Transactions
Dapeswe must not be used to initiate, arrange or develop a transaction and then deliberately move that transaction outside Dapeswe for the purpose of avoiding Dapeswe fees, payment processes, transaction controls or other applicable platform requirements.
In particular, users must not:
- encourage another user to complete outside Dapeswe a transaction that is intended to be completed through Dapeswe;
- use contact details, links, messages, listings, events or other Dapeswe functionality primarily to circumvent an applicable Dapeswe transaction process or fee;
- request or provide alternative payment arrangements for the purpose of avoiding an applicable Dapeswe fee; or
- otherwise structure activity artificially to conceal or move a Dapeswe transaction off-platform.
This does not prevent Customers, Vendors or Advertisers from maintaining independent business relationships, communicating outside Dapeswe or conducting transactions that did not originate from and are not intended to circumvent a transaction facilitated through Dapeswe.
Dapeswe may take action where there is reasonable evidence that Dapeswe has been used primarily to obtain a commercial connection or transaction opportunity and the resulting transaction has been moved outside the platform to avoid applicable Dapeswe fees or requirements.
- BUSINESS CONTENT AND OFFERS
Vendors and Advertisers are responsible for ensuring that the products, services, events, promotions, advertisements and other commercial content they make available through Dapeswe are lawful and accurately represented.
Dapeswe must not be used to offer, advertise or promote anything that:
- is unlawful to sell, supply, advertise or possess;
- is counterfeit or infringes third-party rights;
- is fraudulent or materially misleading;
- creates an unacceptable risk to users or the platform; or
- is otherwise prohibited under applicable Dapeswe terms or policies.
Dapeswe may restrict particular products, services, content or commercial activity where reasonably necessary for legal, safety, payment, platform-integrity or operational reasons.
A Vendor or Advertiser must not present itself as acting on behalf of Dapeswe unless Dapeswe has expressly authorised it to do so.
- RESPECTFUL AND SAFE INTERACTION
Users must treat other users, businesses and Dapeswe personnel with reasonable respect.
Dapeswe must not be used to:
- threaten or intimidate another person;
- repeatedly harass or target another person;
- engage in unlawful discrimination;
- publish another person's sensitive or private information as a means of intimidation or retaliation;
- extort or attempt to coerce another user;
- deliberately interfere with another person's legitimate use of Dapeswe; or
- retaliate against a person for making a good-faith report or complaint.
Commercial disagreement, criticism or a negative experience does not by itself violate this Policy. Dapeswe does not require users to express only positive opinions.
- MODERATION AND ENFORCEMENT
Dapeswe may review content, accounts, transactions or activity where there is a reason to believe that this Policy, the Terms of Use, Additional Terms or applicable law may have been breached.
Depending on the circumstances, Dapeswe may:
- request information or clarification;
- issue a warning;
- remove, restrict or disable content;
- restrict particular functionality;
- require corrective action;
- delay or restrict an activity or transaction where permitted under the applicable terms;
- temporarily restrict an account;
- suspend or terminate access to Dapeswe; or
- take another proportionate action available under the Dapeswe Terms of Use.
Dapeswe is not required to issue a warning before taking action where immediate action is reasonably appropriate, including in cases involving fraud, security, serious misconduct, unlawful activity, risk to another person or attempts to circumvent Dapeswe controls.
Dapeswe may preserve relevant information and cooperate with competent authorities where required or permitted by applicable law.
Moderation does not mean that Dapeswe approves, verifies or assumes responsibility for all content or activity available through the platform.
- REPORTING A PROBLEM
If you believe content, activity or another user is violating this Policy, you can report the matter through an available Dapeswe reporting or complaint function.
Reports should be made in good faith and should contain enough information for Dapeswe to identify and review the relevant matter.
Dapeswe may request additional information where reasonably necessary to investigate a report.
Knowingly submitting false or abusive reports, repeatedly using reporting systems to harass another user or attempting to manipulate Dapeswe through the reporting process may itself violate this Policy.
